Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and Gopher Tech, LLC, the company behind RealFrame (“RealFrame”, “we”, “us”), governing your access to and use of the RealFrame remote-desktop software, applications, websites, and related services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.
1.Eligibility & accounts
You must be at least 18 years old and able to form a binding contract. You are responsible for your account credentials and for all activity under your account. Keep your password and access tokens secure and notify us promptly of any unauthorized use. One person or entity may not maintain more than one free account to circumvent plan limits.
2.Acceptable use
You agree not to use the Service to: (a) access systems or data you are not authorized to access; (b) violate any law or third-party right; (c) distribute malware or conduct attacks; (d) resell or provide the Service as a relay/proxy network; (e) interfere with or place undue load on our infrastructure; or (f) reverse engineer the Service except as permitted by law. The Service is for remote access to machines you own or are authorized to control.
3.Plans, billing & taxes
Paid plans are billed in advance on a recurring monthly or annual basis through our payment processor, Stripe, and renew automatically until cancelled. By subscribing you authorize us to charge your payment method for the then-current fees plus applicable taxes. Prices are stated exclusive of taxes; you are responsible for any sales, use, VAT, or similar taxes. We may change prices on renewal with reasonable prior notice. Per-seat plans are billed per active seat.
4.Free tier & trials
We offer a free tier and may offer time-limited trials of paid features. Free and trial usage is subject to plan limits (e.g. device count, resolution, best-effort relay) which we may adjust. Trial features automatically revert to your then-current plan at the end of the trial unless you upgrade.
5.Cancellation & refunds
You may cancel at any time from your billing settings; cancellation takes effect at the end of the current billing period and you retain paid access until then. Fees already paid are non-refundable except where required by law or expressly stated in a written offer. Limited-run offers (e.g. lifetime or founder pricing) carry the specific terms disclosed at purchase.
6.Your content & data
You retain all rights to the data and content you transmit through the Service. RealFrame sessions are end-to-end encrypted: our coordinator and relay route only ciphertext and we do not have access to the contents of your remote sessions. You grant us the limited rights needed to operate, secure, and improve the Service (e.g. processing account and device metadata). You are responsible for your content and for having the rights to use it.
7.Intellectual property
The Service, including all software, designs, and trademarks, is owned by RealFrame and its licensors and is protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service. We welcome feedback and may use it without restriction or obligation to you.
8.Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure against all threats.
9.Limitation of liability
To the maximum extent permitted by law, RealFrame will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill. Our total liability for any claim arising out of or relating to the Service will not exceed the amounts you paid us in the twelve (12) months before the event giving rise to the claim.
10.Indemnification
You agree to indemnify and hold RealFrame harmless from claims, damages, and expenses arising out of your use of the Service, your content, or your violation of these Terms or any law or third-party right.
11.Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service in a way that risks harm to others or our infrastructure. Upon termination your right to use the Service ends; provisions that by their nature should survive will survive.
12.Changes & governing law
We may update these Terms from time to time; material changes will be notified via the Service or email, and continued use after the effective date constitutes acceptance. These Terms are governed by the laws of the State of Wyoming, excluding its conflict-of-laws rules, and the exclusive venue for disputes is the state and federal courts located in Sheridan County, Wyoming.
